1. Definitions

The online store EMPATH is operated and owned through the website www.empath.ro (hereinafter referred to as the “Site”) by S.C. EMPATH CONCEPT S.R.L., with its registered office at Arsache Street no. 252, Vedea, Giurgiu County, Romania, Unique Registration Number 45047461, Trade Register No. J52/1076/2021.

Within this document, the following terms shall have the meanings set out below:

“Seller” – S.C. EMPATH CONCEPT S.R.L., with its registered office at Arsache Street no. 252, Vedea, Giurgiu County, Romania, Unique Registration Number 45047461, Trade Register No. J52/1076/2021;
“Buyer” – any individual, company, or other legal entity that accesses the Site and places an Order;
“Goods and Services” – any product or service presented on the Site, including those mentioned in the Order or related to the manner in which they are to be provided by the Seller to the Buyer;
“Specifications” – all specifications and/or descriptions of the Goods and Services, including those stated in the Order;
“Order” – the electronic document acting as a form of communication between the Seller and the Buyer, whereby the Seller agrees to deliver the Goods and Services and the Buyer agrees to receive and pay for them;
“Contract” – the Order confirmed by the Seller through the issuance of the fiscal invoice. The Contract is not concluded at the moment the Order is placed or when the Order confirmation is issued.

1.3. By accessing and using the Site or by purchasing the Goods and Services available on the Site, you express your acceptance of the provisions of this document, as well as of the Privacy Policies, which form an integral part thereof, and you undertake to review them periodically. We recommend reading these documents carefully.

2. Modification of the Terms of Use

2.1. The Seller reserves the right to modify the Terms and Conditions at any time, without prior notice or justification. Any changes will be made by updating this document and shall become effective and binding immediately. If you do not agree with the changes, please stop accessing and using the Site. Continued use of the Site or purchase of Goods and Services after the modification of this document constitutes acceptance of the updated Terms and Conditions.

3. Contractual Documents

3.1. By placing an Order, the Buyer agrees to receive commercial electronic communications and/or communications by phone from the Seller. Placing an Order will be followed by contact via email and/or phone confirming that the Order has been placed and will be processed. Such communications do not represent firm acceptance of the Order and do not constitute the conclusion of a distance contract.

3.2. The sending by email of the delivery notification by the Seller, without requiring confirmation of receipt from the Buyer, constitutes the moment of conclusion of the distance Contract and implies full acceptance of the Order terms. The Buyer may cancel an Order before receiving the delivery notification by sending an email to contact@empath.ro. The Order shall be considered canceled once the Buyer receives confirmation of cancellation by email and/or phone from the Seller.

4. Intellectual Property Rights

4.1. All content of the website www.empath.ro is the property of S.C. EMPATH CONCEPT S.R.L. and is protected by copyright law. It may not be copied, partially or entirely, or used to create derivative works without the prior written consent of the owner. Use for any purpose other than personal or non-commercial use is strictly prohibited.

5. Prohibited Conduct

5.1. It is strictly prohibited to:

copy, partially or entirely, disassemble, create derivative works from, or otherwise use the source code of the Site or any element of its content, including but not limited to texts, images, tables, specifications, presentation format, or any other content;
use the Site’s services for purposes other than personal, individual, and non-commercial use;
sell, rent, distribute, transfer, or grant rights to third parties regarding the Site’s services or the user account;
use the Site’s services to invade the privacy of third parties, obtain information about other users, compile user lists, or use data mining technologies, robots, or similar systems.

5.2. In case of violation of any of the above prohibitions, the Seller reserves the right to immediately block, temporarily or permanently, access to the account involved, without limiting its right to seek legal remedies for any damages incurred.

6. Account Registration

6.1. Access to the Seller’s Goods and Services is available online via desktop or mobile devices by creating an account on the Site. The use of the Site requires cookies to be enabled. Account creation requires a personal email address, which will be associated with the user account and used for further communication.

6.2. By creating an account, you declare that the information provided is accurate and complete and accept responsibility for all activities carried out through your account. Accounts are personal and may not be used by third parties. You must immediately notify the Seller if your account security is compromised.

7. How to Place an Order

7.1. By accessing www.empath.ro and navigating through the product categories, you can view detailed information on each product (photos, sizes, colors, and availability).
To purchase a product, click “Add to cart”. Once you have selected all desired products, go to the “Shopping Cart”, review your selection, choose the delivery method, complete the billing and delivery details, and finalize the Order by clicking “Place order”.

8. Pricing and Payment

8.1. All prices displayed on the Site are in RON and include VAT (21%). Delivery costs are not included. There is no minimum order value.

8.2. Due to technical reasons beyond the Seller’s control, certain products may display incorrect prices. If the difference exceeds 20%, the Seller reserves the right to contact the Buyer or cancel the Order.

8.3. The Seller reserves the right to change prices at any time without prior notice. New prices apply only to purchases made after the change.

9. Payment Methods

Payment may be made by cash on delivery or online card payment.
Cash on delivery requires full payment in cash upon delivery. Orders over 800 RON are not eligible for cash on delivery.
Card payments are processed securely online via NETOPIA mobilPay.

No representative of the Seller, payment processor, or bank will ever request your PIN, card number, or CVV.

10. Invoicing

Each confirmed Order includes product specifications, prices, and payment details. The Seller will issue an electronic invoice and send it to the email address used to place the Order.

11. Transfer of Ownership

Ownership of the Goods is transferred upon delivery to the specified address and full payment of the Order.

12. Delivery

The Seller will deliver the Goods within the communicated timeframes. Delivery costs depend on the chosen method.
If visible damage is observed upon delivery, the Buyer is advised to refuse the parcel and notify the Seller immediately.

13. Right of Return

13.1. The Buyer has the right to withdraw from the purchase within 20 calendar days of receiving the products, without penalties or justification, in accordance with Government Emergency Ordinance no. 34/2014.

13.2. Return shipping costs are borne by the Buyer, in accordance with the Return Policy.

13.3. If an incorrect or defective product is delivered, return shipping costs are covered by the Seller.

13.4. Returned products must be in the same condition as received and must not show signs of wear, stains, or animal hair. Otherwise, the Seller may refuse the return.

13.5. Exchanges are possible, with shipping costs borne by the Buyer, in accordance with the Return Policy.

13.6. If the exchanged product is unavailable, the Buyer will be informed and refunded.

13.7. If an Order is not collected and returned to the Seller, future cash-on-delivery orders may be refused. Future Orders will require advance payment.

13.8.–13.9. Promotional gifts must be returned if the qualifying Order is returned or partially returned.

Product Warranty – 200% Guarantee

If you are not satisfied with the quality of the product or print, we will refund your money and you may keep the product.

Claims must be submitted within 60 days of receipt by contacting contact@empath.ro.

14. Account Deletion

Accounts may be deleted upon request, due to contract violations, or after 36 months of inactivity.

15. Limitation of Liability

The Seller is not liable for failures caused by force majeure events.

17. Jurisdiction

These Terms and Conditions are governed by Romanian law. Any disputes shall be resolved amicably or, if necessary, by the competent Romanian courts.
